Applying for Probate
Probate is the process of acquiring the legal right to manage and deal with the estate of a deceased individual. If an individual dies with a Will then probate may be obtained or if not, administration is obtained. In either situation, we can assist and help you obtain a Grant of Representation which is the term that covers both types of circumstances.
We can offer advice and assistance throughout the process when the estate is complex or requires time to be dealt with. The estate may include provision for charities or include foreign assets. The Will left by the Deceased may be contested or issues arise as to the validity of the same. We offer a free of charge consultation to consider the circumstances and advise you of how we can help.
Once you have provided to us valuations of the estate and other relevant information we aim to offer a fixed fee to assist you wherever possible. This is based on the complexity of the estate.
Helping you obtain Grant of Probate only as executors:
Our fees for this service can range between £800 plus VAT to £1,500.00 plus VAT. The average fee can be £800.00 plus VAT where it is clear that inheritance tax is not due on the estate and an application for a transferable nil rate band is not required. In these cases, form IHT 205 will be applicable only.
In cases where an estate requires for a full Inland Revenue account to be submitted (an IHT 400) or where inheritance tax is payable our fees will vary from £1,650.00 plus VAT to £3,500.00 plus VAT. Do note that HM Revenue and Customs can investigate matters relating to these estates therefore we will seek full information regarding the estate in order to provide a fixed fee.
Once the Grant is received, the executors are required to deal with the estate.
Helping you administer the entire estate:
We can assist with the range of steps required to adminster the estate of a Deceased individual to include the following:
- Providing initial advice and gathering the documents and evidence required to complete the probate application
- Applying for the Grant of Representation
- Collecting in estate assets and also paying liabilities, tax and any legacies
- Preparation of full estate accounts and distributing the residue of the estate to the beneficiaries.
Our fees for this will vary depending upon the terms of the Will, or if the deceased died intestate, that is without a Will, the size and complexity of the estate.
The fees we charge for full estate administration will range from £4,500.00 – £5,750.00 plus VAT for a straightforward estate whilst fees for complex cases can exceed £7,000.00. We will aim to consider the details of the estate and then provide a fixed fee quotation to you where possible. When advised, the average charging rate for this work on an hourly basis is £177.00 plus VAT and this might be confirmed in cases where there are overseas assets or a potential challenge to the Will.
Do note that probate fees, statutory advertisement fees and bankruptcy fees will also apply. If you require for a property to be sold within the process then additional fees for the sale will also apply.
It can take approximately 4 weeks to obtain Grant of Probate but this requires for all of the information relating to the estate to be obtained so that the relevant application may be prepared. The administration of an estate can take up to 18 months depending on the size and complexity of the estate.
